Terms and Conditions

This is merely a translation of the German Allgemeine Geschäftsbedingungen (AGB) of EuroSpeedway Verwaltungs GmbH, only the original German version is legally binding.

Terms and conditions of EuroSpeedway Verwaltungs GmbH

§ 1 General

The following terms and conditions apply to all contracts and agreements concluded with EuroSpeedway Verwaltungs GmbH, Lausitzallee 1, 01998 Klettwitz, in particular, with regard to tickets for events on the EuroSpeedway Lausitz organized by EuroSpeedway Lausitz Verwaltungs GmbH, and for the sale of vouchers as well as fan articles.

When any activities take place on the EuroSpeedway Lausitz for which the EuroSpeedway Verwaltungs GmbH is not the organiser and tickets are sold on behalf of and on the account of the actual organiser. The responsible contractual partner for fulfilling the contractual requirements is the actual organiser as EuroSpeedway Verwaltungs GmbH is merely acting as a broker.

For the frequentation of the race track of the EuroSpeedway Verwaltungs GmbH the general rules for frequenting the EuroSpeedway Lausitz apply as well as the rules for the paddock. For the use of the camping site the camping rules apply, for the use of the pits the pit rules apply and for the use of the parking areas the parking area rules apply which are publicly displayed accordingly at the camping place, in the individual pits and on the parking areas.

Any variation to the contract (Terms and Conditions) must be in writing and signed by us. With the placement of the order our Terms and Conditions have been accepted and are valid.

§ 2 Conclusion of Contract

Orders can be placed, by all the regular methods of communication such as by post, per fax, by telephone or the internet. With the receipt of your order by the EuroSpeedway Verwaltungs GmbH the order becomes binding. However the contract is only concluded with our confirmation of order (per e-mail or post) or should a confirmation not be received, with the receipt of the tickets or the goods.

§ 3 Right of Return

When placing your order by telephone or the internet the following applies:

You can revoke a contract on the purchase of fan articles or other goods within 14 days after receipt of the goods. The right of return does not have to be justified and can be made in writing (e.g. letter, email) or by returning the goods. In order to meet the right of return deadline, timely mailing of the letter or the goods is sufficient. The notification of the right of return is to be sent to:

In the case of an effective rescission deliverables shall be returned by both parties. Should you not be able to return goods as a whole or the goods are partially damaged or the good cannot be returned at all you shall have to render compensation. This does not apply in the case of the damages being caused in the course of checking them as would be normally be possible in a shop. Goods shall be returned at our costs and risk unless you have ordered goods to a value of less than 40.00 EUR. In this case the return shipping costs must be borne by you. Obligations of payments shall be met within 30 days after mailing of your rescission.

A contract for the purchase tickets for any of our events can not, according to the legal ruling (§ 312b Abs. 3 Nr. 6 BGB), be revoked.

§ 4 Delivery

The EuroSpeedway Verwaltungs GmbH, according to the agreement made with you, shall deliver the ticket/tickets by sending it/them to the address nominated by you or the ticket/tickets will be deposited at our cash desk , after receipt of payment. Vouchers and / or fan articles EuroSpeedway Verwaltungs GmbH shall be delivered after receipt of payment to the nominated address. Agreed deadlines for payment can be extended by the equivalent time, delivery is delayed due to circumstances beyond the control of EuroSpeedway Verwaltungs GmbH. In such cases you will notified by us immediately.

§ 5 Prices and Payments

The prices and handling fees are from the current price lists valid at the time of order and which are published in the internet for tickets and fan articles. All prices are quoted VAT inclusive.

All invoices by the EuroSpeedway Verwaltungs GmbH must be paid without deductions within 10 days after receipt of invoice. In case of delayed payments interest of 5 percentage points over the prevailing base rate shall be paid. The EuroSpeedway Verwaltungs GmbH is entitled for legal reasons to demand higher interest. A further claim for damages is not ruled out.

§ 6 Liability

The EuroSpeedway Verwaltungs GmbH is, according to the legal requirements on damages to life, body and health, unconditionally liable in case of negligent or deliberate violation of duty by their legal representatives or vicarious agents or liabilities arising out of the product liability law (Produkt Haftungs Gesetz -ProdHG). For other damages the EuroSpeedway Verwaltungs GmbH is only liable if they are based on deliberate or gross negligent violation of duty or fraudulent intent – irrespective of the legal grounds. Notwithstanding this EuroSpeedway Verwaltungs GmbH is also liable for damages that occur through simple negligence if this negligence is regarded as a violation of essential contractual obligations (cardinal obligations) but only for foreseeable typically occurring damage.

Liability of the owner of the EuroSpeedway Lausitz is excluded.

§ 7 Regulations concerning ticket sales

1.
The EuroSpeedway Verwaltungs GmbH reserves the right to make changes without advance notice, that serve exclusively to improve the event, do not endanger the purpose of the contractual use and are reasonable.

The EuroSpeedway Verwaltungs GmbH further reserves the right to postpone events to another time for reasons that it cannot be made responsible for (e.g. bad weather). In such a case the ticket remains valid. Claims for damages due to postponement, of the event shall not be accepted. The EuroSpeedway Verwaltungs GmbH will notify its customers of the cancelled events, provided that this is possible and reasonable. Customers are required to follow the notifications on the internet.

In the case of an event having to be completely or partially cancelled for reasons the EuroSpeedway Verwaltungs GmbH cannot be made responsible for, the EuroSpeedway Verwaltungs GmbH shall not reimburse the entrance fee.

Tickets are only transferable if this is not for commercial purposes.

During events the posted rules of the house are to be adhered to. On using the pit facilities the pit rules are to be adhered to. Provided the camping place is open and entrance is permitted the Camping rules are to be adhered to. When using the parking place the parking place rules are to be adhered to. All rules are posted in the appropriate areas.

4.
The instructions of the race management centre, the personnel of the EuroSpeedway Verwaltungs GmbH and the security personnel are to be followed. Except for seating cushions no unwieldy objects or other objects that could be used as missiles may be taken onto the grandstand. Dogs and other animals are not allowed on the premises. Waste is to be deposited in the rubbish and bins for recyclable waste provided.

5.
In the case of f the customer temporarily leaving the grounds of the event he/she must acquire a pass-out card. These cards are available from the entrance and exit personnel on presenting the ticket. Only tickets combined with the pass-out card authorise their holder to re-enter the area of validity.

6.
Lost or missing tickets shall not be replaced. Tickets shall not be taken back or exchanged.

§ 8 Miscellaneous

Every customer agrees that his/her personal data is recorded processed and used to process the contract.

This Contract shall exclusively be governed by German law, ousting the conflict of laws provisions, and ousting the United Nations Convention On Contracts For The International Sale of Goods (CISG) in the version of 11, 1980, even if the order occurs from or is deliver to a foreign country.

If under these terms and conditions a part of the contract is, or becomes ineffective, the rest of the contract remains valid.
